We respect intellectual property, our own and everyone else's. The Party Expert name, logos, photos, and website content are protected under Canadian and international law. Every licensed brand we carry is sold under an authorized retailer agreement. If you believe something on our site infringes your rights, we take it seriously and respond to valid notices within 10 business days. Send your notice to info@party-expert.com.

Groupe Party Expert Inc. ("Party Expert," "we," "us," "our") respects intellectual property rights and expects all parties interacting with our platform, including customers, vendors, and suppliers, to do the same. This policy explains how we protect our own intellectual property and how we respond to claims of infringement. This policy forms part of our Terms & Conditions and is incorporated therein by reference.
Definitions
For the purposes of this policy:
"Website" means the website party-expert.com and any related subpages, child pages, or secondary pages subordinate to the main page, including any mobile pages.
"Company IP" means all Intellectual Property owned by or exclusively licensed to Groupe Party Expert Inc., including the Website and all content and materials made available by Party Expert through the Website.
"Intellectual Property" means all intellectual property and proprietary rights in any jurisdiction, including rights in trademarks, service marks, trade names, logos, trade dress, domain names, copyrights, moral rights, patents, patent applications, trade secrets, know-how, confidential information, and all registrations and applications for any of the foregoing.
"User Content" means any content a user submits, posts, uploads, transmits, or otherwise makes available through the Website, including reviews, comments, images, videos, and customization inputs.
"Third-Party IP" means Intellectual Property owned by parties other than Party Expert or the user, including brand names and character names that may appear in product titles or descriptions for identification purposes.
Party Expert's Intellectual Property
The following elements are the exclusive intellectual property of Groupe Party Expert Inc. and are protected under Canadian and international copyright, trademark, and other applicable intellectual property laws:
- The "Party Expert" and "Halloween Expert" brand names, logos, and trademarks
- The website design, layout, graphics, icons, and user interface
- All original written content, product descriptions, blog posts, and marketing copy
- Photography, illustrations, and video content produced by or for Party Expert
- The "My Party Points" loyalty program name and associated marks
- Software, code, and technical implementations unique to our platform
No element of this Website may be reproduced, distributed, publicly displayed, or incorporated into derivative works without the express prior written permission of Groupe Party Expert Inc. Except for the limited rights expressly granted to users in this policy, no right, title, or interest in or to any Company IP is transferred, assigned, or conveyed to any user by operation of law or otherwise. All rights not expressly granted are reserved.
Limited License to Use the Website
Subject to your compliance with our Terms & Conditions and this policy, Party Expert grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Website for your personal, non-commercial shopping purposes, including browsing, placing orders, and viewing order history. You shall not:
- Copy, reproduce, modify, translate, create derivative works from, distribute, publicly display, publicly perform, republish, download, store, transmit, sell, rent, lease, lend, or exploit any Company IP except as expressly permitted by the Website's functionality
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices
- Reverse engineer, decompile, disassemble, or attempt to derive source code from the Website, except to the extent such restriction is prohibited by applicable law
- Use any robot, spider, scraper, or other automated means to access the Website for any purpose without our express written permission
- Use the Website or Company IP in a manner that infringes, misappropriates, or violates any Intellectual Property or other rights of any person
Third-Party Licensed Content and No Affiliation
Party Expert sells products under numerous licensed intellectual properties, including but not limited to properties owned by Disney, Marvel, Nintendo, Warner Bros., and other licensors. All third-party trademarks, characters, and brand content are the property of their respective owners.
Where we use third-party brand names, trademarks, product names, or character names in product titles, descriptions, or search terms, this is done solely for descriptive and identificatory purposes as an authorized reseller, and does not constitute a claim of ownership or any affiliation beyond our authorized reseller agreements. Unless expressly stated in writing by Party Expert, nothing on the Website shall be construed as indicating sponsorship, endorsement, affiliation, or authorization by any third party.
Copyright and Permitted Sharing
Except as expressly enabled by the Website (for example, sharing a product link using built-in sharing tools), users may not copy or redistribute Website text, images, videos, product photography, graphics, page layouts, or other content. Any permitted sharing must preserve all proprietary notices and must not imply endorsement or affiliation.
Restrictions on Use of Company IP in Commerce
Users shall not use any Company IP, including Party Expert's trademarks, logos, product photography, or proprietary descriptions, in connection with any commercial activity, including resale listings, marketplace postings, paid advertisements, social media storefronts, or search engine marketing, without Party Expert's prior express written consent. Any goodwill arising from permitted use of Company IP inures solely to the benefit of Groupe Party Expert Inc.
User Content License and Feedback
If you submit User Content through the Website, you grant Groupe Party Expert Inc. a worldwide, royalty-free, fully paid-up, non-exclusive, transferable, sublicensable license to host, store, reproduce, modify (for formatting and display), create derivative works from (solely as necessary to operate and improve the Website), publicly display, publicly perform, distribute, and otherwise use such User Content in connection with operating, marketing, and improving the Website and the sale of goods and services. You retain ownership of your User Content.
To the extent you provide suggestions, ideas, or feedback, you grant Party Expert a perpetual, irrevocable, worldwide, royalty-free license to use and exploit such feedback for any purpose without compensation or attribution.
User Content Representations
You represent and warrant that:
- You own or have all necessary rights, licenses, consents, and permissions to submit the User Content and to grant the licenses in this policy
- The User Content does not and will not infringe, misappropriate, or violate any Intellectual Property, privacy, publicity, or other rights of any person
- The User Content complies with applicable law and does not include unlawful, deceptive, or misleading statements about products, safety, or performance
Party Expert may remove or disable access to User Content at any time in its discretion, including for alleged infringement or legal compliance.
Reporting Infringement
If you believe that content on party-expert.com infringes your intellectual property rights, please submit a written notice to info@party-expert.com with the subject line "IP Infringement Notice," containing all of the following information. Incomplete notices may not receive a response.
- Your full name, company name (if applicable), mailing address, phone number, and email address
- A description of the copyrighted work, trademark, or other intellectual property you claim has been infringed
- The specific URL or URLs on party-expert.com where the allegedly infringing material is located
- If the claim involves copyright: a statement that you have a good faith belief that the use of the material is not authorized by the rights holder, their agent, or the law
- A statement that the information in your notice is accurate and that you are the rights holder or are authorized to act on their behalf
- Your physical or electronic signature
Our Response Process
Upon receipt of a complete and valid notice, we will review the claim within 5 to 10 business days. We may remove or disable access to the allegedly infringing content while the claim is under review. We will notify the party who posted the content of the claim, and that party may submit a counter-notice in response. If we determine that the content does not infringe, or if a valid counter-notice is received, access may be restored. The accounts of parties who are found to be repeat infringers will be terminated.
Counter-Notices
If you believe your content was removed in error, you may submit a counter-notice to info@party-expert.com. Your counter-notice must include your contact information, the URL of the removed content, a statement that the removal was a mistake or misidentification, and your consent to the jurisdiction of the courts of the Province of Quebec.
Misuse of This Policy
Submitting a knowingly false or materially misleading infringement notice may expose the claimant to legal liability under applicable law, including claims for damages and legal costs. Party Expert reserves the right to pursue legal remedies against parties who abuse this process.
Company IP Status
As between Party Expert and users, Party Expert represents that it is the sole and exclusive owner of, or holds a valid license to use, the Company IP made available through the Website, and that its rights in such Company IP are not knowingly subject to liens or encumbrances that would materially interfere with its ability to operate the Website as offered. Party Expert makes no representation regarding Third-Party IP displayed on the Website, which remains the property of its respective owners.
Vendor and Supplier Compliance
Any vendor, supplier, or seller who provides products for sale through party-expert.com represents and warrants that those products do not infringe any third-party intellectual property rights. Vendors who repeatedly supply infringing products will be removed from our platform. Party Expert reserves the right to seek indemnification from any vendor for losses arising from third-party intellectual property claims connected to their supplied products.
Remedies
Unauthorized use, copying, or disclosure of Company IP, or infringement or misappropriation of Intellectual Property, may cause irreparable harm for which monetary damages would be an inadequate remedy. Party Expert and affected rights holders may seek injunctive relief and any other remedies available at law or in equity, in addition to any other rights and remedies under our Terms & Conditions.
Governing Law
This policy is governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, in accordance with the Governing Law and Dispute Resolution section of our Terms & Conditions.
